Terms of Service

The rules for using Hoody's infrastructure. Read them.

  1. 1. Acceptance of Terms

    By accessing or using the Hoody platform, website, APIs, or any related services (together, the "Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms. If you do not agree, do not use the Service.

  2. 2. Accounts

    You must provide accurate information when creating an account and keep your credentials secure. You are responsible for all activity under your account. You must be at least 13 years old (or the minimum digital consent age in your jurisdiction, whichever is higher). We may suspend or terminate accounts that violate these terms.

  3. 3. Acceptable Use

    You agree not to use the Service to:

    • Host, transmit, or generate illegal content (including CSAM, content that incites violence, or content infringing intellectual property rights)
    • Send spam, phishing attacks, or unsolicited bulk communications
    • Distribute malware, ransomware, or other malicious code
    • Attack, probe, or overload Hoody infrastructure or third-party systems
    • Mine cryptocurrency without an explicit written agreement
    • Impersonate another person or entity or misrepresent your affiliation
    • Attempt to circumvent resource limits, rate limits, or access controls

    We cooperate with law enforcement where legally required.

  4. 4. Service Availability

    Hoody provides the Service on an "as-is, as-available" basis. We target high availability but do not guarantee uninterrupted service. Scheduled maintenance, emergency patches, and upstream provider incidents may cause downtime. Service credits for documented outages, when applicable, are governed by the plan-specific SLA.

  5. 5. Billing and Payments

    Paid plans are billed in advance on a monthly or annual cycle. Usage-based charges (overage, bandwidth, storage beyond quota) are billed at the end of each cycle. Taxes are added where required by law. You authorize us to charge your payment method on each renewal. Refunds are not offered for partial months except where required by law.

  6. 6. Your Content

    You retain all rights to the content, data, and code you upload, create, or transmit through the Service. You grant Hoody a limited license to store, process, transmit, and display your content solely as needed to operate the Service. We do not mine your content for advertising or training AI models.

  7. 7. Intellectual Property

    The Service, including software, designs, logos, and documentation, is owned by Hoody or its licensors and is protected by copyright, trademark, and other laws. Open-source components are licensed under their respective licenses. You may not copy, modify, reverse-engineer, or create derivative works of the Service except as expressly permitted.

  8. 8. Termination

    You may cancel your account at any time from your account settings. We may suspend or terminate your access for violations of these terms, non-payment, or legal requirements. On termination we will delete your data within 30 days, except where retention is required by law. You may export your data before termination.

  9. 9. Disclaimers and Limitation of Liability

    The Service is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. To the maximum extent permitted by law, Hoody's total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

  10. 10. Indemnification

    You agree to indemnify and hold harmless Hoody, its affiliates, employees, and contractors from any claim, loss, or damage (including reasonable legal fees) arising out of your use of the Service, your content, or your breach of these terms.

  11. 11. Governing Law and Dispute Resolution

    These terms are governed by the laws of the jurisdiction where Hoody is incorporated. Disputes will be resolved first through good-faith negotiation and then, if unresolved, through binding arbitration. You waive the right to class actions to the extent permitted by law.

  12. 12. Changes to These Terms

    We may update these terms from time to time. Material changes will be announced at least 14 days before they take effect, by email or a prominent notice on the site. Continued use of the Service after the effective date constitutes acceptance of the updated terms.
